Terms of Service
These Terms of Service (“Terms”) govern your use of the KeepSake mobile application and related services (collectively, the “Service”) operated by Hussin Abuaisha (“KeepSake”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age in your country, whichever is higher) to use KeepSake. By using the Service, you represent that you meet this requirement and that you have the legal authority to enter into these Terms.
2. Your account
You are responsible for maintaining the confidentiality of the Apple ID or email credentials you use to sign in, and for all activity that occurs under your account. If you suspect unauthorized access to your account, email support@keepsake.ltd immediately.
You agree to provide accurate account information and to update it if it changes.
3. Your content
You retain all ownership rights in the photos and other materials you upload to KeepSake (“Your Content”).
By uploading Your Content, you grant KeepSake a worldwide, royalty-free, non-exclusive licence to store, transmit, display, and process Your Content solely for the purpose of operating the Service for you — for example, to display your photos inside the App, to back them up, to send them to our restoration providers at your request, and to share them with people you specifically invite.
We will never use Your Content for advertising, and we will never grant any third party a licence to use Your Content for their own purposes.
You represent and warrant that you own Your Content or have all necessary rights, consents, and permissions to upload it and to grant us the licence described above.
4. Acceptable use
You agree not to use the Service to:
- Upload content that you do not own or do not have permission to use.
- Upload content that is illegal, infringing, defamatory, harassing, or sexually explicit, or that sexually exploits or endangers minors.
- Impersonate any person or misrepresent your affiliation with any person or entity.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service, except as expressly permitted by applicable law.
- Interfere with or disrupt the Service, overload it, or attempt to gain unauthorized access to any accounts, systems, or networks.
- Use the Service to build a competing product.
We may suspend or terminate accounts that violate these rules.
5. Subscriptions
KeepSake offers auto-renewing subscriptions (currently “Pro Monthly” and “Pro Yearly”) purchased through Apple’s App Store.
- Payment is charged to your Apple ID at confirmation of purchase and at each renewal.
- The yearly plan includes a 3-day free trial for eligible new subscribers. At the end of the trial, the full yearly fee is automatically charged unless you cancel at least 24 hours before the trial ends.
- Subscriptions automatically renew unless cancelled. You can manage or cancel at any time in iOS Settings › Apple ID › Subscriptions — KeepSake cannot cancel your subscription for you.
- Active subscribers receive a fixed monthly allocation of restoration credits and cloud photo storage, as described inside the App. Monthly credits reset each billing cycle and do not roll over.
- If your subscription lapses, your previously stored photos remain viewable in read-only mode. You will not be able to add new photos or create new albums until you resubscribe.
6. Consumable purchases (credit and storage packs)
You can buy one-time credit packs and storage packs through the App Store. These are “consumables” as defined by Apple.
- Purchased credits do not expire until used.
- Purchased storage is added to your account and remains available for as long as your account exists.
- Except where required by law, consumable purchases are non-refundable. Refunds are governed by Apple’s App Store refund policy and must be requested through Apple.
7. Advanced restoration
KeepSake offers state-of-the-art photo restoration, enhancement, and colorization. Restorations are produced by advanced processing models (currently Google’s Gemini API). The output is automatically generated and may contain artefacts, inaccuracies, or unexpected changes to the image. We do not guarantee any specific quality of result. Original photos are always preserved alongside restored versions.
8. Pricing and taxes
Prices are displayed inside the App in your local currency where supported. Prices may change over time; any change will only apply to new purchases or to subsequent subscription renewals, and we will give you reasonable notice before changing the price of your existing subscription. You are responsible for any applicable taxes.
9. Our intellectual property
The KeepSake name, logo, App, website, designs, and all underlying software and content we provide (other than Your Content) are owned by KeepSake or its licensors and are protected by copyright, trademark, and other laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, solely for your own personal, non-commercial use.
10. Feedback
If you send us suggestions, ideas, or feedback, we may use them without obligation or compensation to you.
11. Service availability and changes
We work hard to keep KeepSake running reliably, but we cannot guarantee uninterrupted or error-free service. We may add, change, suspend, or discontinue features at any time. We may also set reasonable usage limits.
12. Termination
You may stop using KeepSake at any time by signing out and, if you wish, permanently deleting your account from Settings › Delete Account. Deleting your account immediately and permanently removes your photos and account data from our systems, as described in our Privacy Policy.
We may suspend or terminate your access to the Service at any time if you materially breach these Terms, if required by law, or to protect the integrity of the Service or other users.
13. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT RESTORATION RESULTS WILL MEET YOUR EXPECTATIONS.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL KEEPSAKE, ITS OWNER, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50.
15. Indemnification
You agree to indemnify and hold harmless KeepSake and its owner from any claim, loss, liability, or expense (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms.
16. Apple-specific terms
You acknowledge that these Terms are between you and KeepSake, not Apple, and that Apple is not responsible for the App or its content. To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.
17. Governing law
These Terms are governed by the laws of the United Arab Emirates, without regard to its conflict-of-laws rules. You and KeepSake agree to the exclusive jurisdiction of the courts located in the United Arab Emirates for any dispute arising out of or relating to these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction.
18. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top and, for material changes, give you reasonable notice inside the App or by email. If you continue to use the Service after an update takes effect, you accept the revised Terms. If you do not agree, you must stop using the Service.
